CLUB RULES

RULES 

1. Title: The Club shall be known as Broadstairs & St.Peters Bowls Club and shall be affiliated to: Bowls England; Kent County BA/Kent County Women’s BA (Now unified under Kent County B.A.), Isle of Thanet BA; Isle of Thanet Ladies League & the East Kent Bowling Association.

2. Objects: The object of the Club is to provide facilities for and promote participation of the whole community in the sport of bowling. The Income and Property of the Club shall be applied solely towards promoting the Club's objects as set forth in these rules and no portion thereof shall be paid or transferred, directly or indirectly, to the members of the Club. 

3. Constitution: The President - To be invited by the Management Committee plus the following Officers to be elected at the Annual General Meeting each year - Hon. General Secretary and the Hon. General Treasurer - All to serve a three year term of Office. Hon. General Secretary and Hon. General Treasurer shall be eligible for re-election.

4. Management: The management of the Club shall be by a Management Committee (hereafter MC.) consisting of five members to be elected each year at the AGM plus the Officers in Rule 3, Green Ranger, Men & Ladies Captain & a representative of the Bar & Social Committee, five members to form a quorum.

Vacancies occurring on the MC or any other committee, by resignation or any other reason during the year, shall be filled by the MC. The MC may co-opt members to committees to shadow vital positions in the Club but such members shall not be entitled to vote. 

5. Sections: The following shall be elected at the AGM:- Men s Bowling Section, Chairman, Captain, Vice-Captain, Competition Secretary, Secretary,Fixture Secretary. Ladies Bowling Section, Chairperson, Captain, Vice-Captain, Competition Secretary, Secretary, Fixture Secretary, 1 Committee Member.

Also shall be elected a Social Section Committee comprising of a maximum of 5 Members (3 to form a quorum). Selection Committees for Ladies & Men's Bowls sections each to comprise Captain, Vice-Captain and Fixture Secretary, together with 2 members elected at the AGM.

6. Account Examiners: Two shall be appointed at the AGM.

7. Meetings: The AGM shall be held after the close of the season and the date and place to be arranged by the MC but not later than the 31st January in the following year. The MC and all the other Committees shall meet in the Clubhouse or such place or time as may be arranged or by requisition of the President and Hon. General Secretary or by two members of the Committee.

8. Nominations: Nominations for officers and the Committee and Section Members shall be made during the month of August on an official form posted on the Club Notice Board. All nominations must be proposed and seconded and countersigned by the nominee.

9. Membership: Applications for membership of the Club must be made on an official application form, duly proposed and seconded by two full members of the Club and shall be signed by the Candidate. Membership of the Club shall be open to all persons irrespective of ethnicity, nationality, sexual orientation, religion or beliefs nor of age, sex or disability except as a necessary consequence of the requirements of bowling as a particular sport.

The question of election & number of members admitted shall rest with the MC. Acceptance of membership will involve the applicant rendering service in the interest of the Club as may be required by the MC. All members are required to abide by the Rules of the Club. The MC. may refuse membership or expel from membership only for good and sufficient cause, such as conduct or character likely to bring the Club or sport into disrepute. Appeal against such a decision may be made to the Club's members and decided by a majority vote. Persons may not be admitted to membership or be admitted as candidates for membership or to any privileges of membership without an interval of at least two days between their application and their admission. Application forms to be displayed 2 days prior to admission.

10. Life Membership: The MC shall have the sole power to nominate, as an Honorary Life Member of the Club any member or other person who has rendered special or outstanding service to the club. 

11. Associate Members: To become an Associate Member of the Club a person must be proposed and seconded by two full members of the Club and thereafter follow the procedure laid down in Rule 9. An Associate Member is not entitled to make use of the bowls facilities except by paying the concessionary green hire charge but is otherwise entitled to the full privileges of Membership except they will not be entitled to vote at an AGM or sign a requisition for a Special General Meeting of the Club under Rule 14. An Associate member is not entitled to represent the Club in matches.

12. Subscriptions: The Annual subscription shall be determined at the AGM and be due on 1st Aprilof each year. The election of new members is subject to the Annual Subscription being paid within 14 days from the date of the Letter of acceptance, unless otherwise provided.

13. Financial Year: The Club's Financial Year shall be from the 1st November to 31st October.

14. Special General Meetings: A Special General Meeting shall be called when required by the MC or on receipt by the Hon. General Secretary of a requisition, signed by a minimum of 20 members of the Club specifying the subject for which such a meeting is to be called. Not less than 7 days or more than 21 days shall elapse between the Date of Notice and Special General Meeting.

15. By-Laws: The MC may from time to time make, vary or revoke by-laws for the regulation of the internal affairs of the Club and the conduct of its Members. 

The Ladies and Men s Bowling sections of the Club may recommend changes for regulation of members on the greens and in competitions for consideration by the MC. 

By-laws in force from time to time shall be binding on the Members.

16. Bar Committee: The Bar Committee shall consist of a maximum of 4 Members of the Club who shall be appointed by the MC - 3 to form a quorum.

17. Intoxicating Liquor: The Bar Committee shall arrange the supply of intoxicating liquor to Members at such prices as shall, as far as possible, involve the Club in no financial loss (after paying Excise Duty and VAT) and in particular {a} no person shall be paid, at the expense of the Club, any commission, percentage or similar payment on or with reference to the purchase of intoxicating liquor by the Club; (b) nor shall any person directly or indirectly derive any pecuniary benefit from the supply by, or on behalf of the Club to Members or Guests, apart from any benefit to the Club as a whole. A notice shall be posted in the Club showing all prices charged for intoxicating liquors; (c) The MC shall cause proper accounts to be kept and shall present, at every AGM of the Club, a report and Financial Statement for the preceding year; (d) The supply of intoxicating liquor in the Club premises shall be permitted during the following hours: Friday and Saturday 10am - 12midnight, all other days 10am ­- 11pm. Intoxicating liquor shall not be sold to any person who is not a member of the Club but subject to any condition imposed by the licence, this shall not forbid the sale of intoxicating liquor to any guest properly introduced under Rule 18.

18. Guests: Members may introduce and entertain up to six friends at the Club at any one time and there shall be kept at the Club premises a Visitors Book in which both the Members and Friends shall sign. The introducing member shall be responsible for his or her Guests strictly observing the Club Rules and must not leave the Club premises before any of his or her Guests. The MC may suspend any Member who takes undue advantage of this privilege to the detriment of the Club. For the avoidance of doubt any Members of another bona fide Bowls Club visiting the premises for match play or competitors in the Broadstairs & St.Peter’s Open Tournament shall be deemed to be Guests of the MC and Committee. Such of the Members present shall be responsible for the conduct of such visitors whilst they remain on Club premises.

19. Trustees: 

1) There shall be no more than four Trustees of the Club who shall be appointed from time to time as necessary by the Club in General Meeting from among ordinary or honorary & life members who are willing to be so appointed. A Trustee shall hold office during his or her life or until he/she shall resign by notice in writing given to the General Committee or until a resolution removing him/her from office shall be passed at a General Meeting of the Club by a majority comprising two-thirds of the members present & entitled to vote.

2) All property of the Club, including land & investments, shall be held by the Trustees for the time being for the use & benefit of the Club. On the death, resignation or removal from office of a Trustee, the General Committee shall take steps to procure the appointment by the Club in General Meeting of a new Trustee in his/her place: & shall as soon as possible thereafter take all lawful & practicable steps to procure the vesting of all Club property into the names of the Trustees as substituted after the said appointment.

    3) The Trustees shall in all respects act, in regard to any property of the Club held by them, in accordance with the directions of the General Committee.

Indemnity Each member of the Club shall (to the extent that such person is not entitled to recover under any policy if insurance) be entitled to be indemnified out of any & all funds available to the Club, which may lawfully be so applied, against all costs, expenses & liabilities whatsoever incurred by such person in the proper execution & discharge of duties undertaken on behalf of the Club or arising there from, or incurred in good faith in the purported discharge of such duties.

20. Rule Amendments: These Rules shall only be altered at the AGM or a Special General Meeting called for this purpose. Any Notice of Motion in respect of this rule must be in writing, properly proposed and seconded and received by the Hon. General Secretary not later than 30th September in any year.

21. Winding up of the Club: Should the question arise that the Broadstairs & St Peter's Bowls Club be wound up and its assets disposed of, the voting on such a question shall be by ballot of all Club Members. A ballot so taken shall be all members whose names are on the Club Register of Full Members at the time and such ballot shall be completed within 28 days and shall need a majority of at least 75% to succeed, Should such a motion be passed, any assets remaining after preferential creditors have been paid, will be donated to the Pilgrims Hospices (Registered Charity No: 293968)

In the event of any Discretionary Rate Relief being granted by the District Council this will be paid in full, before the distribution of funds, for the financial year commencing 1st April in which the Club is dissolved.
